Who these terms are between
These terms are between you, the business holding the account, and On Your Patch, a trading name of [Company name] Ltd, registered in England and Wales, company number [00000000]. [Review by a solicitor before launch]
This is a business to business service. It is sold to installers, and it is not a consumer product. [Review by a solicitor before launch]
What we provide
You give us the web address of a property listing on a portal we support. We read that page, find the room your trade fits, draw that room in the designs you sell, and compose a printed pack carrying your branding, which you can download as a print-ready PDF.
We support Rightmove and Zoopla. If we stop being able to read either of them, or a portal asks us to stop, we will tell you.
Your account and your trade
- One account is one business. Keep your password to yourself and tell us if you think somebody else has it.
- The product designs kitchens. Every pack you make is a kitchen pack, in kitchen styles, with kitchen words on the sheet.
- Everything you put in the brand kit is yours to put there: your logo, your photographs, your sign off. By uploading them you are telling us you have the right to, and letting us use them to make your packs.
Allowances, and when a pack counts
Each plan carries a number of packs per calendar month.
- Starter
- £29 a month, ex VAT, for 5 packs, which works out at £5.80 a pack.
- Pro
- £89 a month, ex VAT, for 20 packs, which works out at £4.45 a pack.
- A pack is counted once, at the moment the first render is asked for.
- A job that fails before that point costs you nothing, and retrying a job you have already paid for costs you nothing.
- Allowances reset on the first of the month and do not roll over.
- There is no overage. When the allowance is used up, starting a new pack is blocked until the month turns or you move up a plan.
- Looking at, downloading and reprinting a pack you have already paid for is always free.
Paying, VAT and stopping
- Every price we publish excludes VAT, which is added at the rate in force.
- Subscriptions are monthly, taken in advance, through Stripe.
- You can cancel from the billing page at any time. The subscription runs to the end of the period you have paid for and is not refunded pro rata. [Review by a solicitor before launch]
- If a payment fails we will tell you and give you a chance to fix it before the account stops making packs.
What you may do with a pack
The renders and the pack we make for you are yours to use in your own marketing: print them, post them, hand them over, put them on your website, put them on social media. That licence is worldwide, has no end date, and does not cost anything on top.
It is not exclusive, because the same address could in principle be run by another installer, and because we may show anonymised examples of our own work. We will never show a pack carrying your branding as an example without asking you first.
What you must not do
- Do not present a render as a photograph, a survey, a measured drawing or a quotation. It is none of those.
- Do not present a render as a before and after, or as work you have carried out. A before and after is a claim about a job you did, and it has to be capable of being proved. Small print at the foot of a page does not cure an impression the layout has already given. [Review by a solicitor before launch]
- Do not remove the small print from a pack, or edit a pack so that the small print no longer applies.
- Do not suggest that you, or we, are connected to the selling agent, to the portal, or to any manufacturer named on a pack.
- Do not resell packs or access to the service to another business.
- Do not send anything to an address after somebody at it has asked not to be contacted.
Listings and other people’s rights
Listing photographs belong to the agent or the photographer who took them. We read them, hold them privately for the job, and never publish them. They are not in the pack, not on the share page and not on our website, and you must not extract them from the product and publish them either.
Manufacturer photographs are treated the same way: they are handed to the drawing service as a reference and are never printed. Brand and product names are printed only to say what is in the picture, and no endorsement or affiliation is implied.
We are not affiliated with Rightmove, Zoopla, any selling agent, or any manufacturer named anywhere in the product. The line saying so is printed on every pack and must stay there. [Review by a solicitor before launch]
The renders are indicative
This is the clause that matters most, so it is in plain words. Every image in a pack is drawn by a computer from a photograph. It is an illustration of what that room could look like. It is not a photograph, not a survey, not a measurement and not an offer.
The plan page, where one is included, is arithmetic worked from the floorplan the agent published. It carries its own line saying it is indicative, that it is not a survey, and that all sizes are to be confirmed on site. Nothing in a pack has been measured by anybody who has stood in the room.
Every pack comes to you before it goes anywhere. Look at it. If a render is wrong, retry it or do not send it. Once you print or post a pack, what it says to your customer is between you and them, and any promise it is taken to make is yours. [Review by a solicitor before launch]
Where a pack is genuinely unusable because of something that went wrong at our end, tell us and we will put it back on your allowance. A formal refund and credit policy will be published here before launch. [Review by a solicitor before launch]
Printing and posting
Today, printing and posting are yours. We give you a print-ready file set up with bleed and trim marks; what you do with it, and who you send it to, is your decision and your responsibility.
Printing and posting through us is built and is not switched on. If and when it is, the cost will be shown to you before anything is sent, and once a pack has gone to the press it cannot be called back.
Availability, and things going wrong
We do not promise the service is always up. It leans on outside services for reading a listing and for drawing a room, and when one of those has a bad day, so do we. We do promise to tell you what has happened rather than leaving a job sitting there, and to let you retry it at no cost.
Sometimes a listing cannot be read at all: the agent has pulled it, the photographs will not download, or there is no picture of your room anywhere in it. Those jobs cost you nothing.
Our liability
Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else the law does not allow to be limited. [Review by a solicitor before launch]
Beyond that, and because this is a business to business service, our total liability in any twelve month period is limited to what you paid us in that period, and we are not liable for lost profit, lost business or lost opportunity. [Review by a solicitor before launch]
Ending it
- You can cancel whenever you like from the billing page.
- We can end an account, with notice, if these terms are broken, and immediately if the product is being used to mislead somebody.
- The licence over packs you have already made survives the account ending: work you paid for stays yours to use.
Changes to these terms
If these change in a way that matters we will email account holders and put the date at the top. Carrying on using the service after that is taken as accepting the new version. [Review by a solicitor before launch]
Law
These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction. [Review by a solicitor before launch]
