Who this agreement is between
This agreement is between you, the business that holds the account, and On Your Patch, a trading name of CHM Capital Ltd, registered in England and Wales, company number 17466915.
On Your Patch is sold to businesses, not to consumers.
What we do
You draw the area you cover. When a house inside it sells, we find its listing, draw the kitchen in the styles you fit, and make a four page pack with your name and details on it. We can print it and post it to the new owners, or you can download it and print it yourself.
We read listings from Rightmove and Zoopla. If we lose the ability to read either, we will tell you.
Your account
- One account is one business. Keep your password private and tell us if you think somebody else has it.
- Everything you upload must be yours to upload: your logo, your photos, your sign off. By uploading it you are telling us you have the right to, and letting us use it to make your packs.
Packs and plans
Each plan gives you a number of packs a month.
- Starter
- £29 a month plus VAT, for 5 packs. That is £5.80 a pack.
- Pro
- £89 a month plus VAT, for 20 packs. That is £4.45 a pack.
- A pack counts the moment we start drawing the first design.
- If a pack fails before that, it costs you nothing. Retrying a pack you have already paid for costs you nothing.
- Your packs reset on the first of the month. Unused ones do not carry over.
- When you have used all your packs, you cannot start another until next month or until you move to a bigger plan.
- Looking at, downloading and reprinting a pack you have already paid for is always free.
Paying and cancelling
- All our prices exclude VAT. VAT is added at the current rate.
- Plans are paid monthly, in advance, through Stripe.
- You can cancel at any time from your billing page. Your plan runs to the end of the month you have paid for. We do not refund part of a month.
- If a payment fails, we will tell you and give you time to fix it before your account stops making packs.
What you can do with a pack
The designs and packs we make for you are yours to use in your own marketing. Print them, post them, hand them out, put them on your website or on social media. There is no time limit and nothing extra to pay.
We do not promise you an area to yourself. Another fitter could work the same streets. We may show examples of packs on our website, but we will never show one with your name on it without asking you first.
What you must not do
- Do not present a design as a photo, a survey, a measured drawing or a quote. It is none of those.
- Do not present a design as work you have done, or as a before and after. That would be a claim about a job you did, and it has to be true.
- Do not remove the small print from a pack, or change a pack so that the small print no longer applies.
- Do not suggest that you, or we, are connected to the estate agent, the property website or any brand named on a pack.
- Do not resell packs, or access to the service, to another business.
- Do not send anything to an address after somebody there has asked you not to.
Photos that belong to other people
Listing photos belong to the estate agent or the photographer. We read them, keep them privately for the job, and never publish them. They are not in the pack, not on the web page behind the code, and not on our website. You must not take them out of the product and publish them either.
Product photos from manufacturers are treated the same way. They help us draw the room and are never printed. Brand and product names are printed only to say what is in the picture. No brand is endorsing you or us.
We are not connected to Rightmove, Zoopla, any estate agent, or any brand named in the product. Every pack says so, and that line must stay on it.
The renders are indicative
This is the part that matters most. Every picture in a pack is drawn by a computer from a photo. It shows what the room could look like. It is not a photograph, not a survey, not a measurement and not a quote. Nobody has stood in the room with a tape measure.
Every pack says this in print: "These designs show what your kitchen could be. They are not a quote, and nothing has been measured."
You see every pack before it is printed. Look at it. If a design is wrong, retry it or do not send it. Once you have sent a pack, what it says to your customer is between you and them.
If a pack is unusable because of something that went wrong at our end, tell us and it will not count towards your monthly packs.
Printing and posting
When we print and post a pack for you, the cost is shown before anything is sent, and you agree to it by pressing send. Once a pack has gone to the printer it cannot be called back.
If you download the file and print it yourself, what you do with it and who you send it to is your decision and your responsibility.
When things go wrong
We do not promise the service will always be available. It depends on other companies to read a listing and to draw a room, and when one of them has a bad day, so do we. We do promise to tell you what has happened and to let you retry at no cost.
Sometimes a listing cannot be read at all: the agent has taken it down, the photos will not download, or there is no picture of the kitchen. Those packs cost you nothing.
What we are responsible for
Nothing in these terms limits our responsibility for death or injury caused by our negligence, for fraud, or for anything else the law does not let us limit.
Beyond that, because this is a service sold to businesses, the most we will pay you for anything that goes wrong in a twelve month period is the amount you paid us in that period. We are not responsible for lost profit, lost business or lost opportunities.
Ending the agreement
- You can cancel whenever you like from your billing page.
- We can close an account, with notice, if these terms are broken, and straight away if the service is being used to mislead somebody.
- Packs you have already paid for stay yours to use after the account ends.
Changes to these terms
If these terms change in a way that matters, we will email account holders and put the new date at the top. If you carry on using the service after that, you are accepting the new terms.
The law that applies
These terms are governed by the law of England and Wales, and the courts of England and Wales decide any dispute.
